To the maximum extent permitted by law, Talynt and its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the Site;
Any conduct or content of any third party on the Site;
Any content obtained from the Site;

In no event shall Talynt's total liability to you for all damages, losses, and causes of action exceed the amount you have paid Talynt in the last six (6) months, or, if greater, fifty dollars ($50).

You agree to indemnify and hold harmless Talynt and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another.
8. Modifications to the Site and Terms
We reserve the right to modify or discontinue the Site at any time without notice. We also reserve the right to modify these Terms at any time. These Terms shall be governed by and construed in accordance with the laws of the Manitoba, Canada, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Manitoba, Canada for the purpose of litigating all such claims or disputes.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
12. Entire Agreement
These Terms constitute the entire agreement between you and Talynt regarding your use of the Site and supersede all prior and contemporaneous written or oral agreements, communications, and understandings (if any) relating to the subject matter hereof.
13. Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Talynt's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
